Court backs Grace Kpan This paper has learned that demolition carried out recently by former Superintendent Grace T. Kpan was based on an eviction order issued by the Sixth Judicial Circuit, Civil Law Court for Montserrado County.
Monrovia, Liberia, April 22, 2025- Court documents obtained by The NEW DAWN established that recent demolition of several properties in Tweh Farm Community, Montserrado County on behalf of former Superintendent Grace Kpan and her husband Oliver Kpan, was legally executed, contrary to challenge by Mr. Benson Kun and other residents that their properties were unlawfully destroyed.
The demolition, executed April 12, 2025, was based on an eviction order issued by Judge Scheaplor R. Dunbar, of the Sixth Judicial Circuit, Civil Law Court for Montserrado County, sitting in its March Term, A.D. 2022.
The Court had placed in possession of Mrs. and Mr. Kpan 9.25 acres of land in Tweh Farm Community, after ruling in their favor in the case, “Oliver and Grace Kpan Versus Gibson Mayor, Theresa Segbo, Et.AL.,” all of the Montserrado County.
“Plaintiff in the above captioned cause of action is entitled to the above-mentioned/described property by virtue of the Court’s Trial/Court’s Ruling dated 20th day of May A.D. 2021, under the signature of His Honor Scheaplor R. Dunbar, Assigned Circuit Judge, sitting in its March Term, A.D. 2021.
You are further commended to oust, evict and eject the Defendants in the above named/described property/premises and return this Writ of Possession to my Office on/before the Next Term, June, A.D. 2022, ordered on the back of the Original Copy of the Writ of Possession your official Returns as to the manner and form of its service and placing Plaintiffs in complete, full and unrestricted possession to the premises/property described supra”, Judge Dunbar issued an Action of Ejectment, instructing the Clerk of Court.
Documents detail that on June 25 2022 at 5:00pm, a team comprised of personnel of the Ministry of Justice, Alternative Dispute Resolution and the Liberia Land Authority visited Tweh Farm, the property site, and met with community leaders and few community dwellers at Amandia Muslim School Campus within the community.
About 20 persons attended the meeting during which they were informed of the court’s ruling, granting a Writ of Eviction to the Plaintiff to take possession of the 9.25 acre of land that was already occupied by private residents.
But while in the execution of the eviction, the Monrovia City Court presiding Magistrate L Ben BARCON issued an arrest order based on complaint by Resident Benson Kun and others for destroying their houses.
The complainant under oath alleged that the former Montserrado County Superintendent, Madam Kpan on April 12 brought yellow machine operators that destroyed their houses.
The costs of the houses were put at US83 795.00 Dollars and US157, 655 Dollars, amounting to US241, 450.00 Dollars thus, the complainants claim more than US$241,450.00 in damages.
“You are hereby commanded to arrest the living bodies of Grace Kpan and yellow machine operator defendant/s to be identified, and forthwith bring them before the Monrovia City Court, Temple Of Justice Building Montserrado County to answer to the charge of criminal mischief based on the oath and complaint of the Republic of Liberia by & thru Mark Harris Private Prosecutor in which it is substantially alleged as follows in violation of section 15.5 of the New Penal Law of Liberia,” the writ instructed.
According to the writ, the Private prosecutors/trix complained and said that the defendants within named destroyed their properties on Saturday, April 12, A.D. 2025 about the hour of 3.30 pm and in the Tweh Farm Community, Bushrod Island, Montserrado County,” the writ read.
The writ described the action as criminal, unlawful, purposeful and intentional, as she orders the yellow machine operator to break down and destroy private prosecutor property (Two houses.)
But the Board of Arbitration established by Judge Dunbar established that Oliver and Grace, Plaintiffs, presented the title deed.
A warranty deed was produced bearing Oliver and Grace Kpan signed by Sarah M. Jegede as grantor, probated and registered according to law”, the Board observes.
It also observes that the land had been sold by Mr. Koon, who does not have a piece of land in the community.
“From the data and information obtained from the field survey exercise and the various deeds, it is clearly shown that the grantor to all the defendants does not own a piece of land in that vicinity. Yet nearly all the land under investigation had been sold by Mr. Koon as grantor. From all indications, it is proven that the parcel of land under investigation belongs to the plaintiffs, according to the ground and deed’s locations”, The Board argues.
