Justice Peter Lifu of the Federal High Court, Abuja, on Friday, dismissed an application seeking to stop the Enugu State Independent Electoral Commission (ENSIEC) from conducting Saturday’s local government elections in the state.
The judge in his ruling on an oral application filed by counsel for the All Progressives Congress (APC), Michael Aondoakaa (SAN), stated that stopping the election would not serve the justice in the matter.
He argued that there was insufficient evidence at the time the notification letter was delivered to the defendants regarding the trial.

The judge said that under Article 36 of the 1999 Constitution, barring the commission from proceeding with the poll would be contrary to the principle of fair trial.
The APC in its initial call tagged: FHC/ABJ/CS/1325/2024, asked the court to issue a permanent injunction restraining ENSIEC from conducting elections in the state without its participation, among other reliefs.
The Independent National Electoral Commission (INEC), ENSIEC and Nwanfor Alphonsus Onyeachonam are listed as respondents in the lawsuit.
Justice Emeka Nwite of the same court recently refused to grant an application to stop the election.
