The IGBO separatist group forbidden, the native of Biafra (IPOB), has challenged the Nigerian government to produce victims of terrorism and incitement in accusations against its arrested leader, Nnamdi Kanu.
Ipob, in a statement issued Wednesday night by the Secretary of the Media and Publicity, Emma Powerful insisted that the Federal Government did not have a case against Kanu, also asked Judge James Omotosho from the Federal High Court to uphold the legal principles of political sentiment.
The Biafra agitators warned of what they described as an effort to replace the sentiments for law, and insisted that the government had failed to create a prime facie case against Kanu in terrorism and the ongoing incitement accusations.
Strong quoting Judge Binta Nyako before commented that no government can rely on intimidation permanently in substitute for evidence, noting that Omotosho continues to depend on the sentiment in his prosecution of Kanu.
“The prosecution has not submitted an investigation report that connects Mazi Nnamdi Kanu with accusations of terrorism, betrayal, or incitement,” Powerful said in the statement.
He further argues that a case cannot be continued where the investigation foundation is lost, shows that dependence on the testimony by witnesses produced by the State Service Department itself without producing victims who are actually institutionalized and lack of direct evidence.
He also showed that in cases involving the conspiracy or group intentions, the absence of the Co-Defendant mentioned damaged the accusation.
“This is not proof; this is a theater. This is legally unbearable. Who is incubated? Who is the injured party?” Ask strong.
He insisted that group leadership that was prohibited, especially those that were prohibited through ex parte orders, did not set criminal errors, on the grounds that the government had to prove certain criminal acts.
“Freedom of expression including criticism of the government. As far as this case, there is no evidence presented that has linked broadcasts by Kanu with certain results of violence or acts of violation of the law.
“Unless judge Omotosho wants to join those who have tarnished the Nigerian judiciary, he must answer these questions honestly, valid, and brave,
“If the prosecution relies on no investigation report, only DSS witnesses without direct knowledge, no victims are identified, no collaborator named, no jurisdiction for alleged broadcasts, and doubtful ex -parte ban, then there is no case to answer,” added the IPOB spokesman.
