Senate President, Godswill Akpabio, Chairperson of the House of Representatives, Tajudeen Abbas, the National Assembly, Clerk of the NASS, and the Independent National Election Commission (Inec) were also registered as respondents in the lawsuit.

PDP, who searched for six questions for determination, asked whether, with section 68 (1) (g) of the 1999 constitution (as changed), a senator or member of the DPR, such as parliament members, was not responsible for losing their legislative seats after resigning from party membership on the platform they chose.

Therefore, the party prayed to the court to state that the ongoing occupation of the legislative seats by four parliament members after defecting from the party whose platforms they were elected, without fulfilling strict provisions based on section 68 (1) (g) of the 1999 constitution, were violations of the constitution and rending their seats with legal operations.

It also prayed that the court made Mandamus’s orders that attracted Akpabio and Abbas to immediately state their seats empty.
