PDP Governor Sue Tinubu for the Rivers Emergency Regulations, the suspension of elected officials

Eleven Governors elected under the Democratic Party Platform (PDP) have taken their legal battles to the Supreme Court, challenging what they described as executive power outrections by the Tinubu Bola President in suspending the institutions of Rivers’s state democracy.

Legal actions, which were officially submitted on Tuesday, sought constitutional interpretation of the President’s power to suspend elected state officials and impose emergency rules. The lawsuit also questioned the legality of appointing a single administrator to regulate the country during the suspension period.

Although the initial report has indicated that the Governor has filed a lawsuit, Director of Information and Public Relations of the Supreme Court, Dr. Festus Akande, confirmed to The blow that formal submissions occurred on April 2.

The controversial declaration of President Tinubu regarding the emergency in the state of Rivers came on March 18, which resulted in the suspension of Governor Siminalayi Fubara, Deputy Governor of Ngozi ODU, and members of the Rivers State Council Council. In their place, the retired representative of Admiral Ibok Ete Ibas was appointed as the only administrator to manage state affairs for the first six months, a step which was then ratified by the National Assembly.

The Governor of PDP, angry with the decision that influenced one of themselves, has now made legal challenges. The countries involved in the lawsuit are Adamawa, Enugu, Osun, Oyo, Bauchi, Akwa Ibom, Plateau, Delta, Taraba, Zamfara, and Bayelsa. This case, marked SC/CV/329/2025, was submitted through the Attorney General for State of each and was built for above eight reasons for the constitution.

In the lawsuit, the plaintiff asked the Supreme Court to determine whether the President acts in his constitutional power by suspending elected state officials and replacing them with people who are not elected with the guise of emergency government.

They also asked for a decision whether the Tinubu emergency declaration in the state of Rivers was in line with the 1999 constitutional provisions or violated its core principle. Legal questions submit references to several constitutional parts, including section 1 (2), 5 (2), 176, 180, 188, and 305, which are related to the structure of governance, emergency force, and state autonomy.

In addition, the lawsuit challenged the legality of suspending the legislative of the state under the emergency rules and asked for attention to what the governor described as a trend of executive disruption that was troubling in the autonomy of state institutions. Further submission records concerns about the threat of similar interventions in other states.

The Supreme Court has ordered respondents, who are included in the federal government, to enter their performance within 14 days after being served with legal documents.

This lawsuit ended speculation on weeks -weeks about the steps of the next opposition governor after the news of the chair that they were preparing constitutional challenges. Initially, only seven governors, from Bauchi, Adamawa, Bayelsa, Enugu, Osun, Plateau, and Zamfara, were identified as plaintiffs, but four then joined the lawsuit.
