The Federal High Court in Abuja has rejected the lawsuit that is trying to cancel the suspension of the Tinubu Bola President against Governor Siminaayi Fubara from the State of Rivers and members of the State Council Council.
The suspension, which took part in the March 18 declaration on the emergency in the state of Rivers, took place six months and ended on September 18 during that period, President Tinubu appointed a single administrator to oversee the state affairs.
Not happy with the decision, the five indigenous states of the state, led by Mr. Blema Briggs, approached the court, asked him to declare the action illegal and non -constitutional.
Delivering an assessment on Thursday, Judge James Omotosho decided that the Plaintiff did not have a locus stand – legal rights – to sue the President. The court noted that there was no prosecutor who became the governor or member of the Rivers, and they failed to show a special injury suffered outside the population of other states in the state.

Furthermore Judge Omotosho showed that the plaintiff did not get authorization from the Attorney General for the State of Rivers to bring the lawsuit and did not submit evidence that proved their claims.
The court also rejected their argument that Tinubu’s actions violated their fundamental rights. According to Judge Omotosho, the plaintiff could not prove that the right legal process was not followed before the emergency rules.
In addition, the judge believes that the problem, as framed, is a problem that is usually determined by the Supreme Court.
Concluding, Judge Omotosho described this case as “reckless and unfounded,” emphasized that the plaintiff did not have a mandate to institutionalize the action on behalf of other native Rivers.
