The Court empties orders to confiscate $ 378K, exotic cars

Judge Emeka Nwite from the Federal High Court, Abuja, on Thursday put aside a temporary confiscation order of $ 378,000 and Mercedes Benz GLS 600 Maybach to the Federal Government.

Judges in the decision argue that the practice of independent corruption and other related violation commissions (ICPC) hides and suppresses material facts in obtaining orders.

He agreed with the legal counsel, Afam Osigwe (San), that the ICPC failed to tell the court about the problem delayed in the court of your brother where the parties had been ordered to maintain the status quo while waiting for the determination of the problem.

The judge admitted that although ICPC lawyers, Osuobeni Akponimisingha, stated that the commission did not hide any facts because the order had nothing to do with the delayed case, he argued that the law placed so many trust in the party that submitted the order.

He argues that it is the duty of the parties, as subject to the law, to be diligent in their case.

Nwite said: “There is no doubt that the lawsuit is connected to this process. The lawsuit has the capacity to influence this court’s decision.”

“The Petitioner is naturally bound to respect this court order which was made on the 14th day of August 2024.”

“As a result, this court argues that the Petitioner hides and suppresses material facts.”

The judge also directed the ICPC to delete the VIDE post restriction.

He was the same as ordering the release of Mercedes Benz GLS 600 Maybach to be held by ICPC.

Judge NWite on January 6 ordered a temporary confiscation of $ 378,000 and Mercedes Benz GLS 600 Maybach to the Federal Government.

He gave an order after Akponimisingha moved the ex-party motion for the effect.

The judge also directed the commission to publish a notification in the national daily for people who were interested in showing the reasons why cash and vehicles should not be permanently forfeited to the federal government.
