Judge Emeka Nwite from the Federal High Court, Abuja, has refused to provide an application that seeks to stop the former Senate President, leadership led by David Mark from the African Democratic Congress (ADC).
The judge gave the decision in the former party submitted by the former Deputy Chairperson of the ADC, Mr. Nafiu-Bala Gombe, and touched by his lawyer, Michael Agber.
Gombe, in a marked lawsuit: FHC/ABJ/CS/1819/2025, looking for three reliefs.
He asked the court to give a temporary order that arrested the Independent National Election Commission (Inec) from recognizing Mark and Aregbesola as the National Chair and National Secretary of the ADC while waiting for a motion hearing for notification.
He was also looking for orders to detained the orders of temporary orders, Aregbesola, and their cohort from the parade as national chairman and the National Secretary of the Party.

The Plaintiff is equally looking for orders that hold Inec from recognizing and or dealing with both.
Conversely, Judge Nwite directs the gombe to place all defendants on the notification to show the reasons why motions should not be given.
Therefore, he postponed the problem until September 15 for the defendants to show reasons.
The verdict was submitted on September 4, and a copy of orders that were actually provided for journalists on Thursday.
The opposition coalition in July appointed Mark as the temporary national chairman of the ADC and former Governor of State Osun, Rauf Aregbesola, as the National Secretary.
