Three men sentenced to life in prison for raping deaf woman in Kebbi

Justice Sharafadeen Jafar of the Kebbi State High Court, Birnin Kebbi, on Wednesday, sentenced three men to life imprisonment for raping an 18-year-old deaf woman.

The convicts – Amiru Sani, Aliyu Umar and Bashar Dan-Inno of Warfarin Zaromawa village – were charged with two counts of criminal conspiracy and rape.

Counsel, Faridah Muhammad, in her defence, told the court that the defendants committed the act at Wararin Zaromawa village in Gwandu local government area of ​​the state.

He said: “The defendants had broken into the victim’s house, while she was sleeping and forcibly had sexual intercourse with her.

“They strangled her with a thick cloth and tied her hands with rope before having sex with her one by one.”

Legal counsel urged the court to sentence the defendants because the law imposes mandatory sentences.

He said criminal conspiracy and rape were punishable offences under sections 259 and 60 of the Criminal Law Law of Kebbi State 2021.

The prosecutor had previously called three witnesses, and submitted six pieces of evidence in the form of statements in English and Hausa from the three prosecution witnesses to support their case.

Defense counsel Ahmed Abubakar-Filgila called the three convicts to give evidence and testify in their defense without submitting any documents or evidence.

He urged the court to temper justice with mercy.

In his ruling, Judge Jafar said the public prosecutor had proven all elements of sexual relations with the victim.

“I am of the firm view that all the accused conspired in carrying out the act.

“Meanwhile, the defendants conspired and raped the victim, who is an 18-year-old deaf person, who is also a married woman, at her husband’s residence.

“All the elements necessary to establish the existence of a criminal conspiracy to commit rape have been established beyond a reasonable doubt by the prosecutor.

“The court has no choice but to act on the evidence before it.

“Having found you guilty of the said charges, you Amiru Sani, Aliyu Umar and Bashar Dan-Inno are hereby sentenced to life imprisonment under section 259 and section 60 of the Criminal Law of Kebbi State 2021,” he said.
