The position of mass actions under Nigeria’s law

Some of the constitutional provisions of the 1999 Federal Federal Nigeria (CFRN), spoke against unjustified events that occurred in the state of Edo.

While the constitution prohibits the implementation of law without legal justification, the law also condemns anyone who supports the process that violates the law.

For example, part 33 (1) of CFRN gives the right to live as one of the basic rights enjoyed by every Nigerian citizen. This section reads: “Everyone has the right to life, and no one will lose his life intentionally.”

Also, part 36 (5) considers anyone who is accused of committing a criminal offense to be innocent until his mistake is proven. It reads: “Everyone who is charged with committing a criminal offense will be considered innocent until he is proven guilty.”

In the future, mass actions, killing victims without reasonable justification, or other paths to form the same authority as crime and be punished under the Criminal Code Nigeria (laws governing actions violating the law in South Nigeria).

The convention of criminals, namely, encouraging others to kill the victims the same as ‘conspiracy to commit murder’ that can be punished with 14 years in prison under the Criminal Code. The murder of the victim who actually attracted the death penalty under the law.

During the interview, a legal practitioner, lawyer Emmanuel Okorie, condemned the actions of the masses, calling it “heinous” and “savage”. He also marked the incident as a criminal act.

Speaking further, Mr Okorie, who is also the coordinator of the state expectations behind the African bar, a non -profit organization that advocated prison reforms and social justice, identify ignorance, poverty and distortion of the legal system as the main reason that encourages the nuances.

Okorie also argues that the right education, the creation of strong institutions to overcome crime and transparency in the judicial process is a key factor to fight the recurrence of forest justice in Nigeria.

“Our system must be fair. Our system must be open to ordinary people. People must see our judicial system as real, people must be made to believe in the system,” he said.

Why the government’s failure also contributes to the murder

According to Amnesty International, at least 555 cases of mass violence have been recorded In Nigeria over the past decade between January 2012 and August 2023. These terrible numbers have originated from 363 incidents documented in Nigeria.

During that period, the report showed that 57 people were killed by a group of violence, 32 were burned alive, two people were buried alive, while 23 people were tortured to death.

As a result, experts have found government errors, contributing to repeated mass violence in Nigeria.

Speaking of the failure of the security institution to suppress Uromi’s hordes before causing mass murder, Okorie’s lawyer said, “There must be a community of the community. Every time a crime is committed, there must be an effective communication system to security institutions for interference and ensure legal prevention and order.

“In this case what happened in the state of Edo, the police did not intervene quickly. If the police have intervened in the first 15 minutes of the current problem, the lives of those people can be saved. I am sure that 90 percent of them can actually be saved because it takes a long process to burn and kill someone.”

From allegations of theft to blasphemy, transformation and magic, the presence of mass violence has been witnessed in the six Nigerian geopolitical zones: South-South (82), Southeast (43), northwestern (100), North-Central (42), Southwest (98), and northwestern (26), North-Central (42), Southwest (98), and north-sea.

“The failure of law enforcement agencies, especially the Nigerian police, to prevent mass violence, investigate accusations of torture and murder, and bring suspects to the court, empower the masses to kill. The problem is exacerbated by weak and corrupt legal institutions and systems,” said Isa Sanusi, Director of Amnesty International Nigeria.
