The court adjourned the challenge to ADC Wike’s leadership crisis indefinitely

Justice Emeka Nwite of the Federal High Court, Abuja, on Friday adjourned the lawsuit filed by member of the African Democratic Congress (ADC), Mr Nafiu Bala-Gombe over the party leadership dispute indefinitely.

The judge made this decision after receiving arguments from the plaintiff and defense regarding the request to transfer the case to another judge.

“I have listened to the students’ advice from both parties.

“From the submissions of the two attorneys, the Supreme Court has handed down its decision on the appeal between the 2nd defendant (Mark) in this case on April 30 2026.

“However, neither party has provided the original copy of the Supreme Court decision to this honorable court.

“Also, from the submissions of both parties which are also on record, the plaintiff wrote a letter to the honorable CJ of the Federal High Court requesting instant transfer of the suit.

“However, the letter was not copied or delivered to the defendant.

“Taking any decision or action based on this letter without listening to the defendants’ statements is a violation of their basic rights in this lawsuit.

“Also, the letter has been addressed to the CJ of the honorable Court, hence this honorable Court cannot take any decision against it.

“Therefore, it is best that this case be postponed sine die (indefinitely) to give the parties an opportunity to properly submit a CTC decision of the Supreme Court in an interlocutory appeal of this lawsuit, serve the defendants with a letter addressed to His Excellency the CJ and finally wait for further details or directions from the CJ.

“This case is hereby postponed sine die,” the judge ruled.

Bala-Gombe, former ADC National Deputy Chair, has written to FHC Chief Judge, Justice John Tsoho, requesting the transfer of the case to another judge.

Gombe, in the complaint marked: FHC/ABJ/CS/1819/2025, listed the ADC, former Senate President, David Mark, former governor of Osun State, Ogbeni Rauf Aregbesola, the Independent National Electoral Commission (INEC) and Ralph Nwosu as respondents in the case.

Nwosu is the former National Chairman of ADC who resigned due to party leadership David Mark.

Bala-Gombe argued that the emergence of Mark and Aregbesola as party leaders violated the provisions of the party constitution and the Election Law.

At the hearing which resumed on Friday, the plaintiff through his lawyer, Luka Haruna (SAN), apprised Justice Nwite of the latest developments, following the recent Supreme Court ruling.

Haruna drew the court’s attention to what happened before the judge on the last adjourned date.
