The Edo State House of Assembly has appealed against the judgment of Justice JK Omotosho of the Federal High Court, Abuja, which quashed the impeachment of the state’s former deputy governor, Philip Shaibu.
In response to Justice Omotosho’s ruling today, the State Assembly has also moved for a stay of execution of the ruling pending the outcome of their appeal.
Justice Omotosho, in his ruling, quashed the impeachment of Shaibu as deputy governor, citing the failure of the Assembly to comply with due process during the impeachment process. He further quashed the appointment of the new deputy governor who replaced Shaibu.
Shaibu’s dispute with Governor Godwin Obaseki began over his desire to replace his boss. Although Obaseki endorsed Asue Ighodalo as his preferred candidate, Shaibu and nine others opposed Ighodalo, who eventually won the nomination.

Following the nomination process, the Edo State House of Assembly impeached Shaibu on Monday, April 8, 2024, after receiving a report from a seven-man investigative panel headed by retired Justice SA Omonua. The panel had been investigating allegations of misconduct including perjury and alleged leaking of government secrets against the former deputy governor.
Shaibu refused to appear before the panel during the hearing.
Shaibu’s impeachment was supported by 18 of the 19 members present during the Assembly’s plenary session, with one member abstaining from the vote.
Governor Godwin Obaseki then appointed Marvellous Omobayo as his new deputy following Shaibu’s impeachment, to serve the remainder of his second term, which ends on November 11, 2024.
