Court quashes order to stop Kwara local council elections

Justice Peter Lifu of the Federal High Court, Abuja, on Tuesday, quashed an interim order restraining the Kwara State government from conducting local government elections in the state.

The state government had earlier set September 21 for elections in the 16 local government areas in the state.

The judge dismissed the order because it had expired under the law, having been in place for more than 14 days.

He agreed with the submission of counsel to the Kwara State Independent National Electoral Commission (KWSIEC), Johnson Usman (SAN), and the state Attorney General, Senior Sulyman (SAN).

Justice Lifu said: β€œIt is noted that the same ex-parte order has been pending since July 29, 2024.”

He argued that an ex-parte order should not last more than 14 days.

“Because it has been going on for more than six weeks, this lawsuit is hereby dismissed,” said the judge.

The judge on July 29, granted the Peoples Democratic Party’s (PDP) ex-parte motion to stop the National Electoral Commission (INEC) from releasing the national voters’ register to KWSIEC for the election pending the hearing and determination of the substantive challenges.
