EFCC charges woman over alleged N39.8 million fraud

The Economic and Financial Crimes Commission (EFCC) has arraigned Nwodo Martha at the Enugu State High Court for alleged N39.8 million fraud.

Martha, a former General Manager at Fidelity Structures Limited, was charged with nine counts of theft by fraudulent conversion.

One of the charges reads: “That you Nwodo Martha from February to December 2017, in Nsukka Enugu State of Nigeria within the jurisdiction of this Honorable Court committed a capital crime: stealing by fraudulently converting for your personal use a sum of money amounting to Five Million Eight Hundred and Four Ten Thousand Naira (N5, 840, 000. 00) belongs to Fidelity Structures, this amount is payment for the purchase of Brewery products.”

The offence, according to the EFCC, is contrary to Section 342 of the Criminal Code, Revised Edition, Chapter 30, Laws of Enugu State of Nigeria, 2004 and is punishable under Section 353 (1) of the same Act.

However, the defendant pleaded not guilty when the indictment was read to him.

Following his application, EFCC legal advisor, Ahmad Yusuf Abdullahi, asked the court to fix a trial date and return the accused to the Enugu State correctional facility.

However defense lawyer, Chukwuemeka Okpoto Onah informed the court about the pending bail application and later moved the application.

He urged the court to grant bail to his client on liberal terms.

The prosecutor rejected the application on the grounds that the defendant would waive bail.

After hearing both parties, Justice HU Ezugwu granted the defendant N10 million bail with surety of that amount.

He said the guarantor must be a level 13 civil servant and asked the court clerk to verify the guarantor’s address.

The judge then adjourned the matter to July 24 for trial while the defendant was returned to the Enugu State correctional facility pending perfect bail conditions.
