The Commission for economic and financial crimes, EFCC, presented on Wednesday his ninth witness of the accusation in the process of the former governor of the State of the Benue, Gabriel Suswam, for alleged fraud of N3.1 billion.
Suswam was pursued together with his former Commissioner for Finance, Omodachi Okolobia, on an accusation of 11 counts modified at the limit of the diversion of public funds.
The accusations concern the alleged undue appropriation of N3.1 billion, which is said to be income from the sale of the actions of the state Benue detained by the investment and the real estate company Benue Investment and Property Company.
During the proceedings at the High Federal Court of Abuja, the Fcc Consultant Ao Atolagbe informed the Court that the Commission would have closed his case after having presented his ninth witness (PW9), Mr. Ape Sunday, an EFCC investigator.
Atolagbe explained that the Commission was forced to close her case without presenting a tenth witness due to the bad health of Mrs. Shiedu Awade, former cashier and manager of Benue Investment and Property Company Limited, who should have witnessed as Pw10.
Pw9 told the Court that Mrs. Awade was hospitalized in the hospital at the National Hospital, Abuja, and was unable to attend the court due to the serious nature of her illness.
Following the announcement of the accusation, the defense consists of Ce Ugbozor (representing Suswam) and Paul Herokoro, San (representing Okolobia), informed the Court of their intention to present a “submission without case”, claiming that the accusation had failed to establish a first Facie case against their customers.
They took 14 days to present their presentation, while the EFCC asked for 21 days to answer.
Justice Lifu has postponed the question until June 24, 2025, for the adoption of the written addresses of the parties on the presentation without the case.
