FCT High Court postpones hearing of Wike’s suit to curb hunger protests

Justice Sylvanus Oriji of the Federal Capital Territory (FCT) High Court on Thursday, adjourned the hearing on the FCT minister’s motion to restrict hunger protesters to September 4.

The postponement was made after the plaintiff’s attorney, Moses Ebute, served a notice of motion on the defendant.

During the hearing, counsel for the 1st to 4th respondents, Dr. SM Oyeghe, requested that the application be served on them in court, while the other respondents were not present and were not represented by representatives.

Judge Oriji directed the plaintiffs’ counsel to serve all respondents, ensuring that everyone was well informed and represented.

The lawsuits involve prominent figures, including Omoyele Sowore, Damilare Adenola, and others, as well as security chiefs, such as the Inspector-General of Police, the Director-General of the Department of State Services, and the Chief of Army Staff, among others.

In his July 31 ruling, Judge Oriji acknowledged the protesters’ right to protest but restricted them to the stadium due to genuine concerns expressed by the minister regarding the potential disruption to public order and safety.

The court aimed to balance the rights of protesters with the need to protect the movement of citizens and prevent damage to public facilities.

The postponement until September 4 allows all respondents to be properly served and prepared for the hearing, thereby ensuring fair and comprehensive consideration of the motion.
