Kogi: Court of Appeal postpones ruling in Ajaka’s appeal against Ododo’s election

The Court of Appeal, Abuja, on Thursday, stayed judgment in an appeal filed by the Social Democratic Party (SDP) candidate, Muritala Ajaka, and his party challenging the results of the November 11, 2023 governorship election in Kogi State.

The Constitutional Court (Court) ruled that Usman Ododo of the All Progressives Congress (APC) was elected governor of the state after sitting in Abuja on May 27.

A three-member panel led by Justice Ado Birnin-Kudu ruled that the petition lacked substance and therefore dismissed it.

Ajaka and his party challenged the election results on the basis of widespread violations and non-compliance with the Election Law in its implementation by the National Election Commission (KPU).

The three-member panel of the appellate court deferred the decision on the appeal until a date to be communicated to the parties after receipt of all the files submitted in relation to the matter.

Earlier in his statement, Chief Kanu Agabi (SAN), while adopting the papers filed on behalf of INEC, urged the court to dismiss the appeal as baseless.

He said there were inconsistencies in the appellant’s case.

Agabi argued that the appeals court had ruled that if the grounds of a petition were inconsistent with each other, and inconsistent with the damages, then the petition should be dismissed.

He also argued that the evidence presented by the applicant was grossly inadequate, citing the Supreme Court decision.

Legal counsel argued that if the evidence presented was so insufficient, then there was no evidence.

He said, of the dozens of witnesses registered, the applicant only called 25 witnesses.
