On Tuesday, the Ministry of the State of Physical Planning and the Urban Development of Lagos has sealed a construction project in progress located at Plot 18, Block J, within Seagate Estate, Lekki Phase 1, Eti-Mosa Lagos, between charges of falsification, invasion and disobedience to the regulatory directives.
The execution, carried out by the Authority of physical planning permits of the State of Lagos (Laspppa), followed an order of stop-working and a subsequent notice to seal the property after concerns were raised for the legitimacy of the documents of the title presented by the developer who is also a lawyer, Frank Uche Ezela.
Laspppa officials said that the developer would begin the construction of the contested land without valid approvals or documentation verifiable by the appropriate authorities.
The Ministry said that several attempts have been made to obtain clarifications and compliance from the parties involved, but according to what Ezela reported did not respond to official invitations and directives.
The case dates back to a controversy of land ownership that involves multiple parts. One of the applicants, dr. John Umude, who said he had legally acquired 16 and 18 in the estate almost three decades ago, presented a petition to the Ministry, claiming that the developer falsified the documents and started the construction despite having been informed that the matter was before the courts.
The applicant, who claimed to have purchased the plots in 1994 and was the first record assignee, presented documents including an act of sub -Sublease and investigation plan to support his request. He also observed that while Plot 16 was sold in 2013, plot 18 remained in his name and had been fenced, fenced and closed before the developer would have broken down and the construction began.
The Ministry subsequently started an internal revision and invited the original suppliers and real estate developers, Harris Properties. During the review, according to what was reported, the officials confirmed that the documents presented by the developer did not originate from their offices
