The Court of Appeal, Abuja, validated the elections of the local government of the State of Kano held on 26 October 2024.
The sentence followed an appeal presented by the Kano general prosecutor, the assembly chamber and Kansiec, contesting the judgment of the federal high court that canceled the composition of the independent electoral commission of the State of Kano (Kansiec) and the elections of the local government held on 26 October 2024.
On Friday, in a unanimous sentence, a group of judges of three members led by Biobele Georgewill canceled the sentence of the lower court that rejected the list of candidates presented in Kansiec from the faction led by Kwankwas of the Popular Party of Nuigeria (NNPP).
The Court said that the issues relating to the leadership of the Internal Party and nominations to candidates are political issues and not subject to the judicial review.
In another sentence, the appeal court declared that the lower Court was missing from jurisdiction to judge issues relating to the composition and qualification of the state electoral bodies.
The Court clarified that these issues fall within the context of the high court of the state of Kano, not of the Federal High Court.
The decisions effectively reaffirm the legitimacy of the surveys of the local government of October 2024 in Kano, offering a significant legal victory for the government of the State of Kano and Kansiec.
