A Federal Court sitting in Abuja on Monday refused to listen to a motion presented by the agitator of the Nation of Biafra, Nnamdi Kanu, looking for an order that transfers him from the custody of the DSC department to the DSS state service to the National Hospital of Abuja for an urgent medical care.

The judge chair, the judge Musa Liman, said that his Fiat sits as a holiday judge ended today (Monday) and therefore was missing from jurisdiction to entertain such a new question for hearing.

Instead, the judge ordered that the case file was returned to the register to allow the chief judge to rely on another judge.

At the procedures on Monday, Asiwaju Adegboyega Awomolo, San, appeared for the federal government while Uchenna Njoku, San, represented the leader of the prohibited indigenous people of Biafra (iPob).

When the question was called, Kanu’s lawyer informed the judge that his client’s motion was filed on September 1, while a counter-offavit of 37 paragraphs that opposed the transfer request was served by him by the government in the open court.

The lawyer Senior said he did not read the entrusted meter to allow him to answer.

Therefore, he applied for an update to allow him to respond to the sworn declaration, in particular in consideration of the fact that the judge’s holiday ends on Monday.

For his part, Awomolo, San, did not oppose the request for updating, saying that it would be ready to be in court at any time, a new date is set every day.

In a short sentence, Judge Liman ordered that the case file was returned to the register for the chief judge to reassign the matter to another judge.

The judge observed that he would recommend the chief judge for the rapid hearing of the motion since the health of the applicant is involved.

Kanu, in the motion with the charge number: FHC/Abj/Cr/383/2015, has sought an order of the Court for the DSS to move it from their case to the National Hospital.

Giving a discussion of 11 land so that Kanu’s request should be granted, his main consultant, Kanu Agabi, San, said that his client is currently underway before the judge James Omotosho in charge marked: Fhc/Abj/Cr/383/2015.

“The exam revealed problems for his health, including organs such as his pancreas and liver, as well as an emerging lump under his armpit and dangerously low levels of potassium.

“Doctors recommended that they are transferred to the National Hospital as a temporary measure to afford it medical assistance and further prevent the drop.

“The health of the applicant is seriously deteriorating considering the nature of his confinement, thus making the need to bring this question more urgently and have the same holiday judge,” said Agabi.

He said that a letter from doctors to the general manager of the DSS, advising that Kanu’s transfer had gone unanswered.

He said that the urgency of the matter had therefore requested the deposit of the application as a measure to arrest a further decline in Kanu’s health while entertained efforts had been made to treat him.

The lawyer Senior added that the concession of the application would not have caused any injustice on the denunciation (DSS).

In addition, Agabi said that the court “is imbued with jurisdiction to listen and grant the prayers requested in the application”.

Emmanuel Kanu, the younger brother of Nnamdi Kanu, in the security declaration to which he filed, hurt that the leader of the Ipob recently complained of weakness and pain in his body.
