The High Federal Court of Abuja on Thursday, put aside the order that directs the temporary decline of 378,000 US dollars and a Mercedes Benz GLS 600 Maybach to the Federal Government.
The judge Emeka Nwite, in a sentence, considered that the independent corrupt practices and the other related crimes (ICPC) hid and suppressed the material facts in obtaining the order.
Judge Nwite agreed with the defender, Afam Osigwe, San, that the ICPC did not reveal to the Court of an outdated question in a twin court in which the parties had been ordered to maintain the status quo pending the determination of the matter.
The judge recognized that although the commission’s lawyer, Osuobeni Akonimisingha, claimed that the anti-Innesto agency did not hide any fact since the order had nothing to do with the outstanding case, claimed that the law established so much confidence on the part that applied for this order.
Furthermore, it considered that it was the duty of the parties, as the law imposed, to be diligent in their cases.
“It is no doubt that the cause is connected to this procedure”, he added, adding that “the cause has the ability to influence the decision of this Court”.
He said that the ICPC, arriving in court to obtain the order, while the previous order to maintain the status quo by the twin court had not been put aside, was equivalent to an abuse of judicial process.
“The applicant is naturally required to respect the order of this Court issued on August 14, 2024,” he said.
According to the judge, it must be said that this Court and any other court have the intrinsic power to put aside its decision in which the decision was made without jurisdiction and where the decision is short of significant facts.
He said that the Court could also leave his decision if there had been a false representation of material facts or if the non -dissemination of material facts had occurred, among others.
He said that a party is bound by law to make use of the court for all necessary and material facts that would assist the court determine a matter.
“Consequently, this Court claims that the applicant has hidden and suppressed the facts of the materials,” he said.
Judge Nwite, who issued the order by putting aside the provisional decline of 378,000 US dollars to FG, also ordered the ICPC to remove the restriction saw a debt order carried out on the Zenith bank account of Fides et Academy Limited-5074703084.
The judge also ordered the immediate release of the Mercedes Benz GLS 600 Maybach held by the Anti -Corruption Commission.

The money and the vehicle, presumably that these are illegal proceeds, were connected to Paul Chukwuma, CEO and CEO of Fides Et Ratio Academy Limited.
In The Motion Ex-Parte marked: FHC/ABJ/CS/1982/V/2024 and presented by the same ICPC president, dr. Musa Aliyu, San; Chukwuma, prof. Dr. Klaus Sierstorfer and Fides et Ratio Academy Limited were sued respectively from 1st to the 3rd defendants.
Giving 10 reasons why the application should be granted, the president of the ICPC said that the victims of the alleged crime of the interviewees are the federal government of Nigeria and its citizens who pay honestly and diligently taxes as and when they will have to.
He said that the alleged illegal activities of the interviewees continued to cause unspeakable difficulties to the honest Nigerians, in particular to the students of the tertiary institutions.
According to him, without an order of this honorable Court, the applicant cannot legally recover the alleged mobile property already limited, a post-no-deployed order in the recovery account of the commission domiciled with CBN for a correct use for the benefit of the honest Nigerians.
Idris Abubakar, a person in charge of the dispute, department of legal services, ICPC, in the security declaration to which he has deposited, said that the commission received a petition by arguing that the trustee fund of the tertiary education (Tetfund) would have made the payment to an inaccurate projector.
He said during the investigation, it was discovered that Tetfund entered into a memorandum of understanding with two companies to provide ICT services to the tertiary institutions, including University, Polytechnics and Education Colleges.
However, he said that Tetfund has thrown away the conditions given by the public procurement office (BPP) and went on to involve Fides et Ratio Academy Limited.
He said that several funds were subtracted in the agreement.
The officer said that when the ICPC investigators asked Chukwuma to provide them with information on how to cross sierstorfer, the effort has not been successful to date.
According to him, the applicant (ICPC) is still on the trail of Prof. Dr. Klaus Sierstorfer, in order to convince him to clarify some of the statements of Mr. Paul Chukwuma.
However, Chukwuma, on February 20, asked the Court of putting aside the order of provisional decline against its assets.
Chukwuma, represented by Osigwe, urged the Nwite justice to leave the order in the interest of justice.
Osigwe had told the Court that a motion on notice had been presented on behalf of Chukwuma on January 9, looking for a court order by putting aside the order of provisional decline.
The lawyer claimed that the order obtained from the ICPC was an abuse of the judicial trial.
He claimed that the Commission obtained the order after a position had already been presented against Chukwuma in a twin court.
According to him, the order should be issued by the court in which the charge was presented.
