The Court of Appeal refused to reinstate Amaewhule and 26 others as Rivers lawmakers

The Court of Appeal, Abuja, on Friday, refused to set aside a decision ordering the removal of Martins Chike Amaewhule and 26 other members of the Rivers State House of Assembly.

Justice Charles Wali of the Rivers State High Court, Port Harcourt, on May 30 declared the seats of 27 lawmakers who dumped the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) in October last year vacant.

The judge who delivered the ruling in the lawsuit filed by the Speaker of the National Assembly Victor Oko Jumbo and two others also prohibited Amaewhule from parading himself as Speaker of the People’s Consultative Assembly.

Dissatisfied with the decision, the aggrieved member of parliament submitted an application to the appeals court to set aside the decision.

However, at a virtual hearing on the matter on Friday, a three-member appeals court panel stated that overturning the lower court’s ruling amounted to pre-judgment of the appeal currently filed.

The panel then set June 20 for the hearing of appeals filed by lawmakers in their bid to regain their seats in the Assembly.
