● Cancel the planned inauguration
The High Federal Court of Abuja has granted a provisional injunction that prevents the national leadership of the Democratic Party of people (PDP) from appointing a custodian committee to supervise the party affairs in the South-South area.
The Court order was developed by the Hon. JK Omotosho JK.
The cause, marked with FHC/Abj/CS/447/2025, was presented by Alabh George Turnah, which is represented as a zonal secretary of the South-South area of the PDP and on behalf of the members of the zonal committee of the area.
The defendants in the event are Amb. Iliya Damagun, the PDP and the Independent National Electoral Commission (INC).
The actor sought the intervention of the Court to prevent the national leadership of the PDP from interfering with the operations of the South-South Zonal Committee, in particular following the re-election of the leader Dan Osi Obih as vice-president for the South-South area during the Calabar meeting.
The order of the Court, issued on March 10, 2025, limits in particular the PDP, its agents and individuals to convene or recognize any meeting aimed at putting aside the resolutions of the meetings of the South-South Zonal Committee held in Benin and Calabar.
In addition, the Court prohibited the defendants from taking measures to undermine the motion on notice presented by the actor on 6 and 7 March 2025, in search of an interlocutory injunction.
This sentence cancels a press declaration issued on the same day by Hon. Debo Ologunagba, secretary of the national advertising of the PDP.
In the declaration, Ologunagba announced that the National Working Committee (NWC) of the PDP would formally inaugurated the South-South Zonal Guardian Committee on Thursday 13 March 2025, at 11 am at the NEC Hall, National Secretariat of PDP, Wadata Plaza, Abuja.
According to Ologunagba, the custodian committee took on the assignment on March 10, 2025.
However, the injunction of the Federal High Court now prevents the planned inauguration and any action by the PDP to enforce the authority of the custodian committee, pending the hearing of the motion on notice scheduled for March 18, 2025.
Judge Omotosho also indicated that the processes of origin were served on the defendants through replaced means, publishing at the National Office of the PDP at Wadata Plaza, Wuse Zone 5, Abuja or delivering them to any member of the adult staff at the same address.
The Court underlined the need to protect judicial proceedings, ordering the defendants to refrain from actions that could make the motion Nugatorie or useless.
The sentence underlines the continuous internal disputes within the PDP, in particular as regards the leadership and organizational structure of its zonal committees, and lays the foundations for further legal proceedings to determine the final result of the case.
The actor was represented by Lode Jirgba, while Ibrahim Idris (San) and IP Nwaogu Esq. He appeared for the applicant in the movement.
The real certified copy of the Court’s Order was signed by Nasiru Oneshi Suberu, Registrar of the Federal High Court, Abuja.
