A high Court of the Edo State sitting in Auchi canceled the suspension and removal of the president and vice -president of the local government area of Etsako West, the Hon. Zibiri Marvelous and Hon. Benji Ojietu.
The sentence arrives three weeks after a high court in Igarra, the area of the local government of Akoko-Edo, has restored the Hon. Tajudeen Alade as an authentic president of the local government, canceling his alleged impeachment.
In his sentence, the judge Om Obayuwana declared the impeachment procedure against Marvelus and Ojietu Null and Null, stating that the process did not respect section 19 of the Law of the Local Government of the Edo State (as amended in 2002).
The cause, marked with Hau/32os/2025, highlighted that the interviewees did not meet the legal requirements necessary for the impeachment, which included:
●》 the formation of a panel of 7 members to investigate the applicants,
●》 A review of the results of the Chamber of the Edo Edo assembly
●》 adequate service of the impeachment notice to applicants.
The Court also ordered the police inspector to guarantee the protection of applicants while resuming the assignment.
In addition, he has issued a perpetual injunction that prevents interviewees from interfering with the duties of applicants and assign ₦ 1 million each as compensation to applicants.
Reacting to the sentence, the Hon. Marvelous described the sentence as a victory for democracy and appealed to the Governor of the State, the senator on Monday Okpebholo, to respect the decision of the court.
