Court dismisses lawsuit seeking to halt further #EndBadGovernance protests

Justice Peter Lifu of the Federal High Court in Abuja has dismissed an application seeking an interim order to stop protesters from continuing with the #EndBadGovernance protests.

The petition was filed by Danladi Goje, Buky Abayomi, Adiza Abbo and 13 other Nigerians who claimed that their rights to life, personal liberty, private and family life and economic activity would be violated if the protests continued.

In his ruling, Judge Lifu noted that the #EndBadGovernance protests ended last week and no evidence was presented to the court to suggest protesters would gather again later.

The judge also noted that the applicant’s attorney failed to provide the necessary affidavits to support the request for temporary injunction and substituted service.

The petitioners have sued various organisations and individuals, including the Take It Back Movement, Concerned Nigerians, Nigerians Against Hunger, and Omoyele Sowore, as well as the attorney general of the federation and security agencies. They claim that the protests will lead to a breakdown of law and order and cause economic hardship.

However, Judge Lifu dismissed the motion as frivolous and adjourned the hearing on the notice motion until August 29. The petitioner’s attorney, Tsembelee Sorkaa, had urged the court to restrain the respondents from continuing the protest pending the decision on her notice motion.

In court documents, Sorkaa claims his client’s rights will be further violated if the protests continue. He is appealing to the court to enforce the restraining order if it is granted.

However, Judge Lifu’s ruling means that the protests can continue, and the respondents are free to exercise their rights to freedom of assembly and expression.
