The Nigerian Correctional Service (NCoS) said on Thursday that the suspended Head of the Intelligence Response Team (IRT) Inspector General of Police, Abba Kyari, remains in custody.
Justice James Omotosho of the Federal High Court, Abuja, earlier on Thursday dismissed and acquitted Kyari on charges of non-asset declaration.
He was charged along with his brother on 23 counts of non-asset declaration by the National Drug Law Enforcement Agency (NDLEA).
NCoS Public Relations Officer, Federal Capital Territory Command (FCT), Samson Duza, in a chat with journalists in Abuja, said Kyari was facing two separate cases.
He noted that the court’s decision only affects charges that border on alleged misrepresentation of assets.

According to him, the court acquitted Kyari in the case after ruling that prosecutors had not provided sufficient evidence to support the charges.
“He is facing two cases. One case regarding false declaration of assets and the other case related to drug offences.
“People who misrepresent their assets are the ones who are fired for lack of eligibility or evidence,” the spokesperson said.
He explained that the judge described the case as weak, and said that prosecutors could not prove the charges brought against the suspended police officer.
He emphasized that Kyari remains in detention because the second case of alleged drug offenses is still under trial.
“The ongoing drug-related trial has not yet concluded, and therefore, Kyari will continue to be in NCoS custody pending the outcome of the trial,” he concluded.
