The Peoples Democratic Party, PDP, has asked the Ondo State Attorney General and Commissioner for Justice, Dr. Kayode Ajulo, SAN, to resign for legitimizing the alleged unconstitutional appointment of interim committees for the 18 local government councils and 33 LCDAs in the state by Governor Lucky Aiyedatiwa.
In a statement released on Friday by the state spokesperson, Honourable Kennedy Ikantu Peretei, the party said Ajulo violated his oath of office by endorsing the governor’s action.
Reacting to PDP criticism of the governor’s action on Thursday, Ajulo said in a press release that the appointment of transition committees for 18 local governments and 33 local council development areas was the governor’s constitutional right.
The party advised against using the nominees “because every kobo spent in these ghost offices will be legally recovered by them.”
Below is the party’s full statement calling for the Commissioner’s immediate resignation:
“The Ondo State chapter of the Peoples Democratic Party (PDP) is calling for the immediate resignation of Dr Kayode Ajulo, the Attorney General and Commissioner for Justice in Ondo, for violating his oath of office.
“Ajulo in a press release said that the appointment of transition committees for 18 local governments and 33 local council development areas was the constitutional right of the governor, without citing any part of the Constitution from which such powers were derived.
“If a senior lawyer in Nigeria, who should know the laws of our country, is the person urging Honourable Lucky Aiyedatiwa to trample on our Constitution and the pronouncement of the Supreme Court, then he no longer deserves to hold the office of the Chief Legal Officer of the State.
“In a landmark judgment on Thursday, July 11, 2024, a seven-member bench of the Supreme Court of Nigeria declared that democratically elected local government was sacred and non-negotiable.
“Judge Emmanuel Agim who delivered the ruling said that “state governments are perpetuating a dangerous trend by refusing to allow democratically elected Local Government Councils to function, instead appointing their own loyalists who can only be removed by them.”
“It is very unfortunate that Ajulo has tried in vain to legitimise his governorship’s illegality on the same day the Supreme Court made the declaration. The Supreme Court in Nigeria has spoken and the Attorney General is saying something different. What Constitution was Ajulo referring to as the authority to appoint Transition Committees? You cannot put something on nothing and expect it to stick.
“Our party would like to advise those who are appointed to these offices not to allow themselves to be used. Because every kobo they spend in these phantom offices will be legally recovered by them.
“Since Kayode Ajulo, SAN, is unable to advise the governor according to the law, he is advised to resign immediately.
