PDP drags four Osun legislators in court for the defection in APC

The Democratic Party of the Peoples (PDP) asked the Federal Court of Abuja to fire four federal legislators of the State of Osun for having defected the Congress All Progressives (APC).

In four separate causes presented on Wednesday, the party insisted on the fact that the decision of the legislators to download the platform on which they were elected was equivalent to a violation of the 1999 Constitution.

The legislators affected are Senator Francis Fadahunsi (Osun East), Senator Olubiyi Oluwole Fadeyi (Osun Central), Omirin Olusanya (East and West and West Icesa East/West) and Taofek Ajilesora (Ife Central/East/North and South Federal Consituency).

The cases, marked with FHC/Abj/CS/1725/2025, FHC/Abj/CS/1726/2025, FHC/Abj/CS/1727/2025 and FHC/Abj/CS/1728/2025, were presented by the lawyer of PDP, Rapheal Oyewole.

In the seeds, the president of the Senate, Godswill Akpabio and the president of the Chamber of Representatives, Tajudeen Abbas, were listed as second accused.

The National Assembly, its employee and the independent national electoral commission (INC) were united as third to the fifth accused.

The PDP claimed that by virtue of section 68 (1) (g) of the Constitution, the legislators who abandon the party that have sponsored their elections automatically lose their seats unless there is division or merger tests in that part.

The party urged the court to: declare the seats of the four vacant legislators; order the President of the Senate and the President to withdraw their recognition; send Iosc to conduct new elections in the electoral colleges concerned; direct the employee of the National Assembly to stop paying salaries and rights to legislators; AND Forcing them to reimburse all the allowances collected by their defection.

According to the PDP, allowing legislators to maintain their seats despite their defection was a violation of the Constitution and undermines the democracy of Nigeria.

The suits must yet be assigned to a judge.

This development comes weeks after the Osun PDP has dragged another federal legislator, Oluwole Oke (Obokun/Oriade electoral college), before the judge Emeka Nwite for a defection similar to the APC.
