Judge Sylvanus Oriji of the High Court of the Federal Capital Territory (FCT), sitting in Maitama, Abuja, Tuesday 8 April 2025, assigned the sum of N100 million in general damage against a secondary school based in Abuja, Louisville Girls Secondary School, Gwagwalada, for negligence of care, which led to the death of one of his students.
He also assigned the sum of N300,000 against school as a cost of the action.
The judgment was issued in the case, marked with CV/1738/18, presented by the father of the deceased pupil, Kamzie, Ifeanyi Ikpeatusim, against Louisville Girls Secondary School, Gwagwalada.
The actor said that the negligence of the school of duty of diligence led to the death of the nine -year -old daughter, Kamzie, after having ill only a few weeks after his admission in the school as a boarding student.
The deceased kamzie was admitted to the school in September 2017, he was seriously ill by 2 October 2017 and tragically died a few days later.
By giving his judgment, the judge Oriji considered that the negligence of the duty of diligence by the school was truly responsible for the death of Kamzie.
According to the judge, the evidence presented before the Court showed that the deceased was not given adequate attention when he complained about the disease.
While assigning costs against the school, the judge Oriji recognized that no quantity of money could bring the deceased back to life.
He ordered that 10 % of interest was applied to the sum of the judgment from 8 April until complete payment is made.
“The applicant has established his accusations of negligence against the school. There is no quantity of money that can give life to the child.
“The Court, therefore, assigns N100 million against the defendants as general damages, with an interest of 10 % on the sum of the sentence from today, April 8, until the sum of the sentence is paid. Furthermore, the sum of N300,000 is assigned as the cost of the action,” said the judge.
The judge Oriji praised the direction of the school for the improvements made to his bay of illness after Kamzie’s unfortunate death, underlining that the introduction of doctors who attend students twice a day is commendable.
Responding to the relief required by the father in mourning that a school structure was appointed in honor of Kamzie, the judge believed that the father should support the improvements made to the sick bay, which described the memory of Kamzie as honor.
“The Court is of the opinion that this improvement is in honor of Kamzie, as part of the reforms recommended by Kamzie’s family. The applicant should run in the fact that Kamzie was honored by the school through this improvement,” said the judge.
