The federal authorities accused the McIVER Lamonica Democratic Deputy of two counts of aggression after a clash with officers outside an immigration detention center.
Alina Habba – the US interim lawyer for the state and an ex -personal lawyer of President Donald Trump – initially announced the accusations in a post on social media at the end of the Monday.
Habba also said that his office would drop a case of transgression against the mayor of Newark, Ras Baraka, who is also a democrat.
Scenffles broke out when Mciver, Baraka and others made a supervision visit to the Immigration and Dogana Center (Ice) in Newark on May 9. No injuries have been reported.
Democratic legislators were visiting Delaney Hall, which can contain up to 1,000 people and was advertised by the National Security Department (DHS) as the first immigration structure reopened under the new Trump administration.
The videos showed an increasingly heated discussion and a chaotic scene including police, Ice agents, journalists, politicians and demonstrators before the mayor Baraka was arrested.
The formal complaint, not saved on Tuesday, claims that Mciver pushed the Ice agents with the forearms and joined the efforts to prevent them from arresting the mayor Baraka.
The eight -page document includes several screenshots of the cameras worn by ice officers showing Mciver, in a bright red jacket, within a crowd of politicians and police.
It is accused of two counts of aggression, resistance and impediment to certain officers or employees.
The federal law prohibits immigration officials to block access to detention structures for members of the congress who try to conduct supervision, and legislating subsidies and a designated special access staff.
Finally, the members of the congress present on May 9 was granted access and gave a tour of the building.
It is unusual for US lawyers to accuse members of the congress, although not unprecedented.
In the past, individual legislators have faced accusations of fraud, corruption and violations of the financing of the campaign.
Congress members are occasionally arrested for protests, but those accidents are mainly symbolic and rarely lead to criminal accusations.
The accusation of a Member of the Congress requires the public integrity section of consultation or approval approval to Washington DC.
There is a supervision to “avoid compromising the credibility and public perception of the Department of Justice and how judicial proceedings are managed in particular politicians or politically sensitive”, said John Keller.
Keller resigned from the unit in February after the department moved to abandon the case of corruption against the mayor of New York City Eric Adams, one of the numerous high -profile departures since Trump entered office.
The Department of Justice did not immediately respond to an investigation by the BBC on the fact that the protocols established by the agency had come into play in the case of Mciver.
Matt Platkin, the New Jersey Prosecutor General and the State’s highest ranking of the police, defined the accusations against McIVER “an extraordinary phase that requires clear tests of conduct and criminal intention”.
The administration officials and democratic legislators contrary to the ice structure have glued to the accident.
Commenting on the case, Trump told journalists that Mciver had been “out of control” and Dhs said that politicians “stormed the gate and broke into the detention structure”.
Tom Homan, the administration’s border tsar, told journalists that there was a “right way and a wrong way” for legislators to control the structures of the state of detention.
Mciver denied illegal and claimed that he was “fulfilling our legitimate supervision responsibility”.
He called the case against his “purely political”, while the main democrats of the congress have issued a declaration in which the accusation of aggression, impediment or interference with the law enforcement agencies is said to be extreme, morally failed and has no legal base or facts “.
Baraka said that the videos made during the accident “clarify that Delaney Hall’s staff opened the gate and allowed me to enter the property, as well as my departure calm and respectful when he was asked to leave”.
