The court slams schools with a fine of N100M due to negligence in student death

The Federal Capital High Court in Abuja has ordered the Girls Louisville Middle School, Gwagwalda, to pay the N100 million in general compensation for negligence which resulted in the death of a nine -year -old student, Kamzie Ikpeaterusim.

Judge Sylvanus Oriji, in his decision on Tuesday, found the school responsible for failing to provide adequate medical treatment to Kamzie, who fell ill shortly after his confession. The court also applies 10 percent interest on the number of decisions from April 8 to full payment, and provides an additional N300,000 to cover the lawsuit fee.

Mr. IFEATI IKPEATURUSIM, Kamzie’s father, has filed the lawsuit, marking CV/1738/18, accusing that the school negligence directly caused the death of his daughter prematurely. Kamzie, who was treated as a dormitory student in September 2017, became seriously ill on October 2, and died a few days later.

Judge Oriji stated that the evidence presented in the court clearly showed that the schools and agents acted negligently with failing to immediately and adequate meeting Kamzie’s medical needs. “The complainant set up the accusations of his negligence against the school. There is no amount of money that can revive the child,” he said.

However, Judge Oriji acknowledged the positive results of this case: a significant increase from school sick children. “However, Oriji acknowledged the fact that a significant result of this case was an increase in school sickbay after the incident. He noted that the presence of doctors who attended students twice a day was a commendable development.”

While the plaintiff has asked the court to order the school to name a building in honor of Kamzie, the judge considers enough sickbay improvement.

“The court argues that the increase in Sickbay, ensures that doctors are available twice a day, in honor of Kamzie, as part of the reforms recommended by his family. The prosecutor must take place in the fact that Kamzie has been respected by schools through this improvement.”
