The CEO,
MTN Nigeria Communications PLC. MTN Square,
No.1 Awolowo Road, Falomo Roundabout,
Ikoyi,
Lagos State.
Dear Lord,
REQUEST FOR REPAIR OF DAMAGED ROOFS, STOPPING THE FALLING OF HARD SUBSTANCES ON THE ROOFS AND COMPENSATION.
We are acting as attorneys for Pastor Sunday Enikuomehin (hereinafter referred to as “our client”) upon whose instructions we address this letter to your office as a matter of urgent concern.
Our client is the owner and occupier of the property located at no. 1 and 3, Maja Street, Eyita, Ikorodu, Lagos State. Our client’s property existed for more than 12 years before your company built its tree in 2010.
The telecommunications tree owned, operated and maintained by your company “MTN Nigeria Communication PLC”. caused structural damage to our client’s property.

The collapse/debris spillage of the equipment used in the construction of the MTN pole on the roof of our client’s property has caused extensive and severe damage to our client’s property, thus leaving the roof leaking every time it rains.
This was reported separately to your security officer who reliably informed our client that reports made to your company’s relevant authority were ignored.
Your company’s negligence in placing this dangerous tree very close to our client’s property has resulted in tremendous damage caused to our client’s property and the worry suffered daily over damage from debris from your tree. Your company has a duty of care to ensure that its mast structures are safely designed, regularly inspected and properly maintained so that they do not pose a danger to surrounding lives and property. Your failure to prevent this destruction constitutes gross negligence and breach of duty.
The continuous excrement of hard substances from your mast portends dangers both for our client’s properties and for the inhabitants who live there. Your company has used its commercial interest to deprive and deny the owner of the adjacent property the benefits and peace needed on his land.
Your company’s activities pose a great danger to the safety of our client and his property. We hereby ask you to immediately mitigate these horrendous dangers that threaten our customer’s safety and peace of mind.
TAKE NOTE that the calamities coming from this pole have indeed placed our client and other residents living on the property in great apprehension.
We ask your company to put an immediate end to these dangers posed by your pole.
Our client sought a token of ₦25,000,000 (twenty-five million Naira) for the pain, anguish, apprehension, danger he has been subjected to over the years due to the threat posed by the danger of hard substances on his roof, the apprehension he suffers from and the repairs required to his property.
Please also note that in the event of your company’s failure, refusal and negligence to do what is necessary within the time limit of 14 (FOURTEEN DAYS) of receipt of this letter, we will, without further correspondence with you, proceed to court to seek compensation against your company and the consequences of this will be that our client will refer the matter to the appropriate regulatory agency overseeing your organisation,
The choice is yours to treat this letter lightly, at your company’s risk.
Best regards,
By: Benson Enikuomehin & Co.
