Court dismisses Kanu’s N1 billion lawsuit against Nigerian government

Justice James Omotosho of the Federal High Court, Abuja, on Monday, dismissed a fundamental rights suit filed by the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, against the Nigerian government.

In the suit marked FHC/ABJ/CS/1633/2023, filed on his behalf by his lawyer, Aloy Ejimakor, the IPOB leader is seeking N1 billion in damages for alleged violation of his rights while in detention.

The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi and the Department of Foreign Services (DSS) are listed as respondents in the suit.

Kanu claims that the DSS and its Director-General violated his right to a fair hearing by allegedly preventing his lawyers from interacting freely with him in custody.

In the motion, the detained Biafran agitator seeks a declaration that the defendants’ decision to seize and photocopy confidential legal documents relating to the preparation of his defense is illegal.

It also requested “a declaration that the defendant’s decision to stop his legal advisor from taking notes during professional discussions/consultations with him in DSS custody constitutes a denial of his right to be provided with adequate facilities for the preparation of his defense by a legal practitioner. his own choice.”

In his ruling, Judge Omotosho dismissed the lawsuit as baseless.

He noted that there is no evidence to suggest that Kanu’s attorneys did not receive a fair hearing as claimed in the lawsuit.

He argued that Kanu failed to provide credible evidence to support his claim that his interactions with his lawyer were interfered with.
