The Edo State High Court in Benin, on Friday dismissed a lawsuit seeking the removal of Lawrence Okah as Secretary of the All Progressives Congress (APC) in the state.
Justice Mary Asemota dismissed the case after the plaintiff’s attorney, Ifeoma Okpara, informed the court that her client had filed a notice of dismissal of the case.
The lawsuit, marked No. B/228/26, filed by Comrade Curtis Ugbo with APC, National Working Committee (NWC), and Okah as respondents.
The plaintiffs have sought judicial intervention in the party’s leadership structure in the state.

Okah has challenged the court’s jurisdiction to accept the case and the hearing was adjourned to May 22.
At the resumption of the hearing, Okpara informed the court that the parties had met and that he had authority from the plaintiff to dismiss the case.
He said that they had filed a notice seeking the court’s permission to dismiss the case on May 7, on the basis of the notice of dismissal under the rules of Order 23, one of the rules of the Edo State High Court.
Counsel for the accused, Mr Ehiogie West-Idahosa (SAN), who led 17 other lawyers, did not contest the discontinuance notice but demanded N2 million as costs.
Therefore, the judge dismissed the case following notice of discontinuance by the plaintiff and awarded N100,000 as costs to be paid by the plaintiff.
