The ADC leadership battle continues as the court sets a date to hear the lawsuit against Mark, and others

Justice Peter Lifu of the Federal High Court, Abuja has fixed September 28, for the hearing of a lawsuit filed by Nafiu-Bala Gombe challenging the leadership of the David Mark-led African Democratic Congress (ADC).

Gombe in his lawsuit asked the court to prevent David Mark and others from presenting themselves as party leaders.

The lawsuit was set for hearing of all pending applications before Judge Peter Lifu.

However, the case could not be continued because the judge was not present.

The lawsuit marked FHC/ABJ/CS/1819/2025 was postponed until September 28.

Justice Lifu had on June 16 resolved the matter to hear the pending application after rejecting separate applications from the ADC and its National Secretary, Rauf Aregbesola, and requested that Justice Lifu dismiss the case.

The judge held that the application had no merit and awarded costs of N1m each against ADC and Aregbesola in favor of Gombe.

The ADC and Aregbesola had requested the recall of the judge on grounds of alleged bias.

Gombe, in his substantive complaint, asked the court to restrain Mark, Aregbesola and members of the party’s interim National Working Committee from parading themselves as ADC leaders.

He argued that the appearance of Mark, Aregbesola and other interim members of the NWC violated the provisions of the ADC constitution and the Electoral Act.

Gombe joins ADC, Mark, Aregbesola, the Independent National Electoral Commission and the party’s former National Chairman, Ralph Nwosu, as the first to fifth defendants respectively.
