The Supreme Court quashes the status quo order and sends the Mark-led ADC dispute back to the trial court

Nigeria’s Supreme Court on Thursday ordered a new hearing into the leadership crisis rocking the African Democratic Congress, ordering a faction led by former Senate President David Mark to return to the Federal High Court.

In a unanimous ruling, a five-member bench of the supreme court, led by Mohammed Garba, overturned an earlier Court of Appeal directive that had ordered all parties to maintain the status quo pending the resolution of the case.

The court of appeal found that the appellate court had erred in granting the order, effectively setting it aside and paving the way for the substantive issues surrounding the party’s leadership battle to be heard and resolved in the court of first instance.

The ruling marks a significant turning point in the ADC’s long internal crisis, as it reopens legal proceedings that could redefine the party’s leadership structure for future political activities.

While the details of the underlying dispute were not fully disclosed in the brief ruling, the Supreme Court’s decision underlines its position on procedural fairness and the need for lower courts to give full vent to disputed political issues.

The case is expected to resume in the Federal High Court, where the parties will make arguments over the leadership’s claims and counterclaims that have divided the party.
